1. Acceptance of Terms
By accessing and using the KejaHub platform, you agree to be bound by these Terms of Service and all applicable Kenyan laws and regulations, including the Data Protection Act (2019) and the Computer Misuse and Cybercrimes Act (2018). If you do not agree to all of the terms and conditions, you are prohibited from using this service.
2. User Accounts & Age Requirement
You must be at least 18 years old to create an account on KejaHub. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.
3. Property Listings & Verification
Landlords and Property Owners must provide accurate, truthful information regarding property listings. All new accounts for property owners are subject to strict verification, requiring the upload of a valid national ID or business registration document from the Cabinet Secretary responsible for lands. Listings are subject to an activation fee and subsequent administrative approval before becoming visible to potential tenants.
4. Payments and Fees
All payments on KejaHub are processed securely through Stripe and other integrated payment processors. Listing activation fees, tenant reservation fees, and other charges are non-refundable unless expressly stated otherwise. KejaHub retains the right to modify fees with 30 days notice.
5. AI Features & Content Generation
Our platform utilizes Artificial Intelligence (OpenAI, Google Gemini, and other models) to enhance search and generate property descriptions. While we strive for accuracy, AI-generated content should be independently verified by users before relying on it for important decisions.
6. User Conduct & Prohibited Activities
Users must not:
- Upload false or misleading property information
- Engage in fraudulent transactions or payment disputes
- Harass, threaten, or discriminate against other users
- Use the platform for illegal activities under Kenyan law
- Attempt to hack, bypass, or compromise platform security
- Violate intellectual property rights
7. Limitation of Liability
KejaHub serves as an intermediary platform connecting tenants, landlords, and property agents. We are not a party to any lease agreement, tenancy dispute, or property transaction. KejaHub is not liable for:
- Disputes between landlords and tenants
- Non-payment of rent by tenants
- Property damage or maintenance issues
- Actions by third-party service providers (transport, utilities, etc.)
- Inaccurate information provided by users
8. Intellectual Property Rights
All content on KejaHub, including logos, designs, and software, is the property of KejaHub Ltd or its licensors. Users grant KejaHub a non-exclusive license to use uploaded content for platform operations and marketing purposes.
9. Data Protection & Privacy
Your personal data is protected under the Kenya Data Protection Act (2019). KejaHub commits to secure data handling and will not sell personal information to third parties without explicit consent. Please refer to our Privacy Policy for complete details.
10. Termination of Service
KejaHub reserves the right to terminate or suspend accounts that:
- Violate these Terms of Service
- Engage in fraudulent or illegal activities
- Have unpaid fees or outstanding disputes
- Violate Kenyan law
11. Dispute Resolution
Any disputes arising from the use of KejaHub shall be governed by the laws of the Republic of Kenya and resolved through the Kenya Arbitration Rules or mediation before pursuing legal action.
